WJA Munich IP Conference 2018

 

The WJA Munich Conference IP Protection & Trademark Rights was held on May 3 – 4 at the Courtyard® & Residence Inn® Munich East Hotel in Munich, Germany. The successful conference featured an array of high level interesting presentations and events. The Opening Ceremony begun with speeches from Dr. Alexander Löw, President of the Organizing Committee & President of the WJA for Europe & Germany; Dr. Franklin Hoet-Linares, WJA Worldwide President; Hon. Justice TAO Kaiyuan, WJA President for Asia & China; and Marc F-X Groebl, member of the Board of Directors of the Munich Bar Association.

First day sessions included:

  • Franklin Hoet Linares, Founding Partner at HPCD, on Multiple Protection Strategies in the Fashion Design Business in LATAM;
  • Brian Smith, Partner at Robinson & Cole, on US Copyright Protections;
  • Yann Meniere, Chief Economist at the European Patent Office, on The Economic Impact of the Unitary Patent;
  • Orlando Viera Blanco, President of the Canadian-Venezuelan Engagement Foundation, on the Impact of Counterfeiting and Illegitimate Markets in the Social, Economic and Institutional Field;
  • TAO Kaiyuan, Vice President of the Supreme People’s Court of the People’s Republic of China, on the Reform and Development of Intellectual Property Protection of Chinese Courts;
  • WANG Chuang, Deputy Chief Judge of the 3rd Civil Division of the Supreme People’s Court of the People’s Republic of China, on the Development of China’s Trademark Protection Rules and System;
  • JIANG Ying, Chief Judge of the 1st Trial Division of Beijing Intellectual Property Court of the People’s Republic of China, on the Practice and Prospect of the Intellectual Property Case Guidance System in China;
  • LING Song, Deputy Judge of the 1st Trial Division of Shanghai Intellectual Property Court of the People’s Republic of China, on the Promoting Judicial Protection of Scientific Innovation and Enhancing IP International Exchange against the Background of Globalization; and
  • HUANG Huihuan, Chief Judge of the Case-Filing Division of Guangzhou Intellectual Property Court of the People’s Republic of China, on Research on Market Value of IP & Key to the Difficulty of Determining Tort Damages Compensation.

The day closed with a moving Commemorative Ceremony held at the Munich Olympic Village near the Munich Massacre Monument in remembrance of the 11 Israeli Athletes and the German Police Officer murdered in 1972 during the Summer Olympic Games. The ceremony, greatly organized and produced by Adv. Yehoshua Nener, WJA Israel President, was initiated by Dr. Hoet and a prayer in the athletes’ memory recited by a Rabbi.

Adv. Nener delivered the opening speech, emphasizing that the world must unite against terrorism. Keynote Speaker, Hon. Jus. Miriam Naor, President (ret) of the Supreme Court of Israel, reviewed the events unfolding the act of terror, highlighting the unfortunate refusal of Germany to allow the Israeli Special Forces to release the hostages.

Following speeches were delivered by Mrs. Ankie Spitzer, widow of Andre Spitzer, athlete murdered during the massacre, and Mr. Yoram Domb, husband of Esther Roth-Shahamorov, surviving Israeli athlete. Other speakers included the Deputy Consul of Israel in Munich, Mr. Liran Sahar, Dr. Alexander Löw, and Dr. Franklin Hoet, who delivered his most moving message on behalf of the organization.

Through the videos screened behind the speakers, many of the participants were exposed for the first time to the details of the Munich Massacre. Attendees expressed how deeply moved they were and promised to transmit the indelible impression left by the ceremony to jurists and friends in their home countries.

Day two sessions included:

  • Jacint Soler-Padró, WJA Spain President, on the Internet Company’s Monopoly – A Risk to our Freedom?
  • Panagiotis Rigopoulos, Lawyer of the European & International Legal Affairs of the European Patent Office, on the Recent Developments at the EPO and the EPO as a Key Harmonization Driver;
  • Alexander Löw, President of Data-Warehouse GmbH, on Challenges of Small and Medium Enterprises in IP;
  • Jesús Becerra, Corporate Criminal Defense Attorney and Lecturer at the Universitat Pompeu Fabré Barcelona, on the Criminal Law Consequences of the Protection of Intellectual Property Through Self Help under Spanish Law; and
  • Ramón Soler-Padró, Partner at Soler-Padró v. Hohenlohe Engel, on the Impacts of Social Media on the Civil Society.

A vibrant Closing Ceremony was held at the traditional Bavarian restaurant Ratskeller of the Munich City Town Hall. Hon. Jus. Peter Umeadi, WJA President for Africa, honored the Closing Statement of the Conference. Typical Oktober Fest gifts were presented as well as beautiful presents from the Chinese delegation, and a Bavarian music and dance show delighted the WJA Global Council, members and participants, who even joined in for a dance.

The WJA greatly appreciates the participation of attendees from countries as far as Canada, USA, Latin America, Nigeria, Israel and China, among other countries. Furthermore, WJA is proud of and thankful with the Organizing Committee, Dr. Alexander Löw and family, Sven Kohlmeier, Alexandra Lohr, Carola Dirscherl, Yacky Rodríguez and all the Data-Warehouse Gmgh team, who worked very hard to put together such a successful and high-quality event.

Expectations now rely on the upcoming 26th Biennial Congress in Madrid, Spain, to be presided by H.M. the King of Spain in 2019, and on the next Conference to be organized by the WJA Israeli team, probably in Jerusalem, which would give us the opportunity to reunite with our friends from the Israeli Supreme Court and the unforgettable and hardworking WJA member Dr. Ethia Simha.

WJA President’s Speech – Commemorative Ceremony to the Munich Massacre

A ceremony was held by the World Jurist Association on May 3, 2018, to commemorate the Munich Massacre of 11 Israeli Athletes and one German police officer during the Olympics.

On September 5, 1972, during the 20th Olympic Summer Games, a savage terrorist attack occurred at the peaceful Olympic Village in Munich, Germany, where Athletes from all over the world were gathering. At the time of that horrifying act, the sports magnus event was in its second week. The attack was performed by a Palestinian terrorist group called Black September, and the target and victims were the Israeli Olympic delegation.

11 Israeli Athletes were taken hostages and some of them suffered physical abuse by their kidnappers. Unfortunately, after a failed rescue attempt, eventually, all the hostages were brutally killed, alone with a German Police Officer. The terrorist attack shattered the dreams of many athletes, who were excited to come to Munich and take part in the world’s most important and awesome sports event – The Olympic Games.

The Munich Massacre shocked the World and had an immediate effect on the Olympians. Some competitors left the village out of fear, and the mood of the ones who remained was sad. Many leaders from around the world condemned this brutal coup de main. The U.S. President Richard Nixon even discussed a number of possible American responses and, eventually, decided with Henry Kissinger to press the United Nations to stand out against international terrorism. King Hussein of Jordan was the only Arab leader who denounced the attack publicly, calling it a “Savage crime against civilization, perpetrated by sick minds”.

In September 2017, the German government officials put forth a clear-cut tribute to commemorate the 11 Israeli Olympic Athletes who were murdered at the 1972 terrorist’s attack. This permanent memorial to the “Munich Massacre”, where we stand today, was opened at the site of the 1972 Olympic Games Terrorist Attack, in presence of the German president Frank-Walter Stenmeier and the president of the State of Israel Reuven Rivlin. Both leaders attending the opening ceremony condemned the killing as an act against the Olympic spirit and values that should have never occurred.

What happened here in 1972, how it happened, why it happened, is still worth our attention and remembrance. Terrorists committed an act opposing the spirit of collaboration of the Olympic Family and violated the essence of the Olympism. I fully endorse the comments by His Majesty King Hussein, President Stenmeier of Germany, President Rivlin of Israel, and those of the President of the International Olympic Committee Thomas Bach.

The legal community condemns all kinds of terrorism. This was an attack not only on our fellow Israelis but also an assault on the values that the World Jurist Association stands for: Peace and Justice. This repugnant act against innocent people was against all the civilization, the Human Rights and the Rule of Law.

The World Jurist Award presented to Dr. Javier Cremades

 

Madrid, March 8, 2018 | The lawyer and founder of the Cremades & Calvo Sotelo office, Javier Cremades, received yesterday from the president of the World Jurists Association (WJA), the Venezuelan Franklin Hoet, the ‘World Jurist Award’ for his professional work.

The event was chaired by the Minister of Justice, Rafael Catalá, and was held at the German Embassy for the links of the winner with this country as a young man he studied the doctorate at the University of Regensburg. Cremades becomes the fourth Spanish lawyer to obtain this WJA distinction since its creation in 1963, after Joaquín Garrigues, Antonio Garrigues and Juan Manuel Fanjul succeeded.

The German ambassador, Peter Tempel, highlighted the fact that he is an “incombustible promoter” of the defense of freedom of expression in the media, while the president of the WJA stressed that he promotes “the value of Rule of Law” together with the protection of Human Rights.

Cremades wanted to thank for an “unexpected” award that, in his opinion, it owes to the team of lawyers who work in his firm and to his maxim of serving people above all. “We are not with cases, but with people”, he said.

According to his point of view, we must fight against the abuses of power, “which tends to perpetuate and corrupt”, as well as against the disaffection of the system propagated by populist parties. Therefore, asked to be “very careful” with those who ask to “reinvent” the constitutional system or defend pro-independence causes in Catalonia under the premise that “freedom is above rights, something totally false”.

In the act they were former ministers like Alberto Ruiz-Gallardón, César Antonio Molina or Eduardo Serra; the president of Repsol, Antonio Brufau; former judges of the Constitutional Court like Manuel Aragón or Álvaro Rodríguez Bereijo; former Ibero-American secretary general, Enrique Iglesias; the former mayor of Caracas, Antonio Ledezma; or journalists Pedro Ruiz and Isabel Gemio.

Proposed Amendments to WJA 2012 Charter & By-Laws

 

Dear WJA Members,

On behalf of the Board of Governors we are glad to announce that, from the Board Meeting held on January 24, 2018, the proposal to Amend the WJA 2012 Charter & By-Laws (below) was approved. This project was presented last year by President Dr. Franklin Hoet, as his vision to enhance and revitalize the operations of the association through decentralization. The drafting counted with the support, ideas, and advice of several active WJA members and an external DC Attorney specialized in NGOs, so as to adapt our regulations to the current related DC & US laws.

During the Board Meeting, the Final Draft of the Amendments for the 2012 Charter & By-Laws was approved by the unanimity (8/8) of Members of the Board attending and/or being represented there. Only one member of the Board could not attend the meeting, perhaps owing the time difference (China). The approval, hence, exceeded the minimum of 66% votes required by the current Charter & By-Laws. It is worth mentioning that only one (01) vote from President & Past President Dr. Franklin Hoet Linares and only one (01) vote from Executive Vice President & General Counsel Garry E. Hunter were taken in consideration, even though they both held two positions within the Board.

Therefore, and following all the procedure established for amending and/or repealing the WJA Charter & By-Laws, we enclosed on an email on January 26, 2018 the approved project and the corresponding ballot to all members entitled to vote. As per the current regulations, the Amendments Draft most be published and distributed to all members in good standing at least ninety (90) days before the vote is tallied. Unfortunately, owing internet connection problems, we could not upload the document on the website the same day it was sent to those members entitled by the WJA 2012 Charter & By-Laws to vote.

We requested members entitled to vote to, after carefully reviewing the Amendments proposed, return their ballot as soon as possible, and no later than April 26, 2018. The final vote will be tallied on April 26, 2018, and a majority of all votes cast will determine the decision to adopt these amendments. As of January 24, 2018, the number of members in good standing was sixty-two (62). Therefore, the majority required for this process will be thirty-one (31) plus one (1), meaning thirty-two (32) votes. Given the case, once this amount of approving votes is received, the Charter & By-laws will take immediate effect.

Ballots enclosed in the email sent to the membership in good standing should be exclusively returned to the WJA Executive Vice-President & General Counsel, Dr. Garry E. Hunter, at:

Only one ballot per member in good standing as per January 24, 2018 will be counted. Duplicates will not be accepted.
